ABSTRACT
Our subject is entitled "Problematic in execution for the
decisions of the Mediation Committee in Rwandan law."
The choice of this subject was motivated by the influence of
the institutionalization of the Mediation Committee in the system pre -
judicial in our country, especially in relation to disputes arising from the
implementation of decisions of the Mediation Committee. We were mainly
motivated by the responsibility of the authorities responsible for the
enforcement of the decisions ie non professionals bailiffs who are exempt from
this burden at the expense of the state considered committing these bailiffs.
Our research has also been harnessed to provide answers to the problem. In this
vein, we asked the following questions:
- Who is responsible for the damage caused by non-professional
bailiffs in the execution of decisions of the conciliation committee?
- Before which court challenges to enforcement of the
Mediation Committee are they made? Is the poor performance in legal matters for
the non professional bailiff to the bad execution of the mediation committee
decisions?
To the first question, we said non professional bailiffs incur
personal liability. This response has facilitated the resolution of the second
and third question: challenges to implementation of decisions of the mediation
committee involving the liability of bailiffs will be non-professional,
flawless, brought before the Mediation Committee which made the decision at
first instance level and, thus, the non professional bailiffs will be best
placed to carry out the decisions of the Mediation Committee because their
service is free and they are the neighbors to the parties and finally
institutionalizing the system of judge of execution.
At the last question, we answered that poor enforcement of the
Mediation Committee decision is the result of non qualification in law agents
of lower instances (Executive Secretary of the sectors and cells). Our work was
considering the overall objective to lift the confusion, in terms of personal
jurisdiction in the application of Articles 10, al.3 and 25 of the Organic Law
of 06.09.2010 No. 02/2010/OL on Organization, Jurisdiction, Competence and
Functioning of the Mediation Committee, the liability for the damage caused by
bailiffs unprofessional.
In our research, we use various methods and technique. We used
the comparative method, analytic and synthetic. And finally we have made use of
technical documentation.
Our work is divided into three chapters before they started
with the introduction and a conclusion at the end. The first chapter is devoted
to the conceptual and theoretical framework. We treated, in the second chapter,
the execution of decisions of the Mediation Committee and in the last chapter
which is the third, we discussed the recovery issues related to the
implementation of decisions of the Mediation Committee.
