Public Contracts sector occupy a prominent position among the
different sectors of activities of the State. Because of the multiple and
substantial interests that it generate, this sector is in the field, the most
place where the phenomenon of corruption that plagues the State institutions,
is developed. That's why the Public Contracts system is subject of constant and
perpetual reforms. One of the most significant of these reforms was made in
2011, at the occasion of the government organization by the President of the
Republic. Indeed, the Decree No. 2011/408 of 9 December 2011 created a
ministerial department exclusively devoted to the management of the Public
Contracts. New entities for the award of Public Contracts have been set up. The
new Regional and Departmental Delegations of Public Contracts, and Local
Tenders Boards thus entered in effective function from the beginning of the
2013 financial year. Prerogatives assigned to them where supposed to contribute
to a better implementation of the basic principles of Public Contracts which
determines the performance of the system. This study analyzes the status of the
Cameroonian Public Contracts performance by means of the duties of the new
stakeholders of the Public Contracts award. The study shows that the taking of
office of the personal of the Regional and Departmental Delegations of Public
Contracts and members of the new Local Tenders Boards, rather than contributing
to the implementation of the basic principles of the Public Contracts system,
is currently maintaining the bad practices observed in the Public Contracts
system for many decades and that yet justify the reform. These bad practices
are encouraged by the lack of punishment of the malfonctions committed by these
new actors of the system.
